Terms of Use

1. Who we are

Padel Amigos (the "app") is an independent hobby project operated by Andreas Resch, an individual based in Thailand, trading as "Andys Apps" ("we", "us", or "our"). You can reach us at helloandysapps@gmail.com.

2. Acceptance of these Terms

By downloading, installing, or using the app you agree to these Terms of Use. If you do not agree, do not use the app.

3. Eligibility

You must be at least 13 years old to use the app. If you live in the European Economic Area or the United Kingdom, you must be at least 16 years old (or have your parent or guardian's consent if your country sets a lower age). The app is not intended for children below these ages.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on a mobile device that you own or control, for your personal, non-commercial use, in accordance with these Terms and the applicable app store's terms (Apple App Store or Google Play).

5. Apple App Store users

If you obtained the app from the Apple App Store, the following additional terms apply:

• These Terms are between you and us only — not with Apple. We, not Apple, are solely responsible for the app and its content.
• The license granted in these Terms is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services in relation to the app.
• Apple is not responsible for any product warranties, whether express or implied. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and consumer-protection claims.
• In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, we (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

6. Google Play users

If you obtained the app from Google Play, your use of the app is also subject to the Google Play Terms of Service. Google is not responsible for the app or any claims relating to it.

7. Account and identity

The app uses an anonymous device-based identity — no email, phone number, or password is required. You are responsible for activity performed under your identity on your device. You agree not to impersonate other people or use offensive nicknames.

8. Acceptable use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws.
• Harass, abuse, threaten, or harm other users.
• Attempt to reverse-engineer, decompile, or interfere with the app or its servers.
• Use automated scripts, bots, or scrapers to interact with the app.
• Upload content that is offensive, infringing, hateful, or otherwise inappropriate.

9. User content

You retain ownership of the content you create within the app (group names, game notes, nicknames). By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, and display that content as necessary to operate the app and provide it to other members of the groups you participate in.

10. Service availability

We strive to keep the app available at all times, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the app at any time. Where reasonably possible, we will provide advance notice of significant changes.

11. Disclaimers

To the maximum extent permitted by law, the app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the app. Our total aggregate liability arising out of or relating to the app shall not exceed the greater of (a) any amounts you have paid to us in the twelve months before the claim, or (b) USD 10.

13. Consumer rights (mandatory protections)

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have as a consumer that cannot be excluded or limited under the law of your country of residence. In particular:

• If you are a consumer in the European Economic Area or the United Kingdom, you retain the consumer-protection rights granted by the law of the country in which you reside, and the disclaimers and limitations above apply only to the extent permitted by that law.
• If you are a consumer in Thailand, your rights under the Consumer Protection Act B.E. 2522 and the Unfair Contract Terms Act B.E. 2540 are unaffected.
• If you are a California resident, nothing in these Terms is intended to waive any non-waivable rights you have under California consumer law.

14. Termination

You may stop using the app at any time and delete your account from the Settings screen, which permanently removes your account and associated data. We may suspend or terminate your access if we reasonably believe you have violated these Terms or if your conduct is harmful to other users.

15. Governing law and disputes

These Terms are governed by the laws of Thailand, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the app shall be brought exclusively before the competent courts of Thailand.

Exception for consumers. If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in the courts of your country of residence, this clause does not deprive you of that right, and you may also rely on the mandatory consumer-protection rules of your country of residence.

16. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when the latest revision took effect. Material changes will be highlighted in the app or on this page. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
